   On July 6^th, 2026, staff issued a Notice of Tentative Decision approving this tree removal request. On July 11^th, City accepted a Request for Public Hearing appealing staff’s tentative approval,  filed by a neighbor who’d submitted a comment in opposition. Staff initially accepted the appellant’s request and scheduled a hearing before the Development Review Commission on August 17^th. Subsequently, staff received legal advice that, per HB 4037 (effective as of July 1, 2026), the city can only accept appeals from the applicant for Type II tree removal decisions associated with the development of housing on the Clear & Objective track. The applicant and appellant were notified of the State-mandated change to the city’s process, and the DRC hearing was cancelled.
